5 CreditsProperty with Practicum explores the origins and current state of the American law of private property. Its principal focus is on real property although it also introduces the law of various aspects of personal property. The course will examine the origins of private ownership, adverse possession, the scope and nature of freedom of alienation, property interests in land, including the fee simple, defeasible fees, life estates, future interests, co-ownership of real property, landlord-tenant law, the purchase and sale of real property, mortgages and other methods of financing, the recording system, title insurance, nuisance. the law of servitudes including easements, real covenants, and equitable servitudes, nuisance, and zoning. Throughout the semester, the course examines contemporary problems, trends, and policy issues. The Practicum focuses on developing practical skills including interviewing, counseling, negotiation, and drafting in the areas of real estate transactions and servitudes which are relevant to practice. The students will participate in simulations and have an opportunity to draft legal documents, thereby giving them a deeper understanding of the relevant doctrine and introducing them to skills needed in practice.
