Both the Fourth Amendment and Article I, Section 12 of the New York State constitution provide in exactly the same words that ‘[t]he right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures shall not be violated and no Warrants shall issue, but upon probable cause supported by Oath or affirmation, and particularly describing the place to be searched and the persons, or things to be seized.” Selected Topics in Criminal Procedure: Fourth Amendment Issues will provide students with a thorough and in-depth analytical understanding of major principles underlying federal and New York State search and seizure procedural law and will emphasize the major similarities and critical differences in both systems.
